Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Made of Copper ("we", "us") covering your use of the Brolendar app and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Brolendar. If you are under the age of majority where you live, a parent or guardian must agree to these Terms on your behalf.

4. Your content

You own the reminders, names, photos, and other content you add to Brolendar. You give us a limited, worldwide, royalty-free license to store, display, and transmit that content solely to operate the Service, for example to show a reminder to the other members of its calendar and to include its title in a push notification.

Content you add to a shared calendar is visible to every member of that calendar. Choose your crew carefully. You are responsible for having the right to share anything you post.

Calendar owners can remove members, and members can leave at any time. When you leave a calendar, content you created there may remain visible to the remaining members as part of their history.

5. Notifications

Brolendar sends push notifications when a reminder's check-in time arrives and when another member logs that they reminded you. You can turn notifications off in your device settings at any time, but the app will not be useful without them. Delivery depends on Apple's and Expo's notification services and on your device being online, so we cannot guarantee that any notification arrives at an exact time.

Brolendar is a tool for friends to nudge each other. It is not a substitute for a medical, legal, financial, or safety-critical reminder system. Do not rely on it for anything where a missed notification could cause harm.

6. Beta software

Brolendar is currently offered as a beta through TestFlight. Features may change, break, or be removed, and data created during the beta may be reset before public release. We appreciate feedback and bug reports, and by sending them you allow us to use them without any obligation to you.

7. Ending things

You can stop using the Service at any time and can ask us to delete your account as described in the Privacy Policy. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service. Sections 4, 8, 9, and 10 survive termination.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that notifications will be delivered on time.

9. Limitation of liability

To the fullest extent permitted by law, Made of Copper and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.

10. Indemnity

You agree to defend and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or someone else's rights.

11. App Store terms

Brolendar is distributed through Apple's App Store and TestFlight. Apple is not a party to these Terms and has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to comply with Apple's applicable terms and any third-party terms that apply to your use of the app.

12. Governing law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. If a court finds any part of these Terms unenforceable, the rest remains in effect.

13. Changes

We may update these Terms from time to time. If a change is material we will update the date above and, where practical, notify you in the app. Continued use after a change means you accept the updated Terms.
